Shuup INC (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, retain, disclose, and safeguard your information whenever you access or use in any manner any Shuup application, product, service, feature, technology, content, or website (collectively, “Services”). By registering or signing up for a Shuup account, including through a computer or mobile device, you accept the terms of this Privacy Policy. Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE SERVICES.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Services after the date such revised Privacy Policy is posted.

This Privacy Policy does not apply to the third-party online/mobile store from which you install the Services or make payments, including any in-game virtual items, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

Shuup INC participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss–U.S. Privacy Shield Framework. The following affiliated entities adhere to the Privacy Shield principles: Anders Innovations Inc. Shuup I NC is committed to subjecting all personal data received from European Union (EU) member countries and Switzerland, in reliance on the Privacy Shield

Shuup INC is responsible for the processing of personal data it receives under the Privacy Shield Framework and subsequently transfers to a third party acting as an agent on its behalf. Shuup I NC complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

With respect to personal data received or transferred pursuant to the Privacy Shield Framework, Shuup INC is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Shuup INC may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

In compliance with the Privacy Shield Principles, Shuup INC commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Shuup INC at:

Shuup INC has further committed to refer unresolved Privacy Shield complaints to JAMS EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield Frameworks, an alternative dispute resolution provider located in the United States. The services of JAMS EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield Frameworks are provided at no cost to you.

Under certain conditions, more fully described on the Privacy Shield website, you may be entitled to invoke binding arbitration when other dispute resolution procedures have been exhausted.

COLLECTION OF YOUR INFORMATION

We may collect information (including information about you) in a variety of ways. Without this information, we may not be able to provide you with the Services. The information we may collect via the Services depends on the content and materials you use, and includes:

Personal Data

We ask for basic information from you in order to set up your account. For example, we may require individuals who sign up to provide a name, username, email address, password, mailing address, phone number, photograph, birthdate, passport, driver’s license, Taxpayer Identification, Social Security, or other government-issued identification number.

Public Profile Information

If you have an account with us, we collect the information that you provide for your public profile. For example, if you have a Shuup account, your username is part of that public profile, along with any other information you put into your public profile. Your public profile is just that – public – so please keep that in mind when deciding what information you would like to include.

Content Information

Depending on the Services you use, you may also provide us with information about you in the published content for your online store. For example, if you post a product that includes its manufacturer’s information, we will have that information, and so will anyone with access to the Internet, if you choose to publish the post publicly.

Website Credentials

Depending on the Services you use, you may provide us with credentials for your website (like SSH, FTP, and SFTP username and password). For example, to allow us to troubleshoot problems on their site more quickly.

Communications with Us

You may also provide us information when you respond to surveys, communicate with our staff about a support question, or post a question about your site in our public forums.

Derivative Data

Information our servers automatically collect when you access the Services, such as your native actions that are integral to the Services, as well as other interactions with the Services and other users via server log files.

Financial Data

Financial information, such as data related to your payment method (e.g. valid credit card number, bank account number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from the Services. We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor, Stripe, and you are encouraged to review their privacy policy and contact them directly for responses to your questions.

Tax Information

Tax information including withholding allowances and tax filing status.

Information about your Business

Information you provide about you or your business (including physical address, Tax ID, appointment, staffing availability, employee, payroll and contact data).

Information you provide to an account owner using our Services

Information you provide to an account owner using our Services, for example if you are an employee whose employer uses Shuup (including hours worked, name, and job title). Some information is collected to comply with applicable laws and regulations, including anti-money laundering laws.

Facebook Permissions

If you connect your account to Facebook, the Services may access your Facebook basic account information, including your name, email, gender, birthday, current city, and profile picture URL, as well as other information that you choose to make public. We may also request access to other permissions related to your account, such as friends, checkins, and likes, and you may choose to grant or deny us access to each individual permission. For more information regarding Facebook permissions, refer to the Facebook Permissions Reference page.

Data from Social Networks

User information from social networking sites, such as Facebook, Google+ Instagram, Pinterest, and Twitter, including your name, your social network username, location, gender, birth date, email address, profile picture, and public data for contacts, if you connect your account to such social networks. This information may also include the contact information of anyone you invite to use and/or join the Services.

Geo-Location Information

We may determine the approximate location of your device from your IP address. We collect and use this information to, for example, calculate how many people visit our Services from certain geographic regions. We may also collect information about your precise location via our mobile apps (when, for example, you post a photograph with location information) if you allow us to do so through your mobile device operating system’s permissions.

Mobile Device Access

We may request access or permission to certain features from your mobile device, including your mobile device’s Bluetooth, calendar, camera, contacts, microphone, reminders, sensors, SMS messages, social media accounts, storage, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Data

Device information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide. We may access information stored on your mobile device via our mobile app. We access this stored information through your device operating system’s permissions.

Information from Cookies & Other Technologies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Pixel tags (also called web beacons) are small blocks of code placed on websites and e-mails. We use cookies and other technologies like pixel tags to help us identify and track visitors, usage, and access preferences for our Services, as well as track and understand e-mail campaign effectiveness and to deliver targeted ads.

Push Notifications

We may request to send you push notifications regarding your account or the Services. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

Third-Party Data

Information from third parties, such as personal information or network friends, if you connect your account to the third party and grant the Services permission to access this information. We may also get information about you from other sources. The information we receive depends on which services you authorize and any options that are available.

We may also get information from third party services about individuals who are not yet our users, which we may use, for example, for marketing and advertising purposes.

Data From Contests, Giveaways, and Surveys

Personal and other information you may provide when entering contests or giveaways and/or responding to surveys.

Log Information

Like most online service providers, we collect information that web browsers, mobile devices, and servers typically make available, such as the browser type, IP address, unique device identifiers, language preference, referring site, the date and time of access, operating system, and mobile network information. We collect log information when you use our Services – for example, when you create or make changes to your shop on your cloud domain.

Usage Information

We collect information about your usage of our Services. We also collect information about what happens when you use our Services (e.g., page views, support document searches at shuup.com, button clicks) along with information about your device (e.g., mobile screen size, name of cellular network, and mobile device manufacturer). We use this information to, for example, provide our Services to you, as well as get insights on how people use our Services, so we can make our Services better.

USE OF YOUR INFORMATION

Having accurate information about you permits us to provide you with a smooth, efficient experience. Specifically, we may use information collected about you via the Services to:

  • (1) To provide our Services – for example, to set up and maintain your account, host your store, backup and restore your products, or charge you for any of our paid Services.
  • (2) To further develop our Services – for example by adding new features that we think our users will enjoy or will help them to create and manage their websites more efficiently.
  • (3) To monitor and analyze trends and better understand how users interact with our Services, which helps us improve our Services and make them easier to use.
  • (4) To verify your identity.
  • (5) To monitor and protect the security of our Services, detect and prevent fraudulent transactions and other illegal activities, fight spam, and protect the rights and property of Shuup and others.
  • (6) To communicate with you about offers and promotions offered by Shuup and others we think will be of interest to you, solicit your feedback, or keep you up to date on Shuup and our products.
  • (7) To personalize your experience using our Services, provide content recommendations and serve relevant advertisements.
  • (8) Administer sweepstakes, promotions, and contests.
  • (9) Assist law enforcement and respond to subpoena.
  • (10) Compile anonymous statistical data and analysis for use internally or with third parties.

By Law or to Protect Rights

If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction. We may disclose information about you when we believe in good faith that disclosure is reasonably necessary to protect the property or rights of Shuup, third parties, or the public at large. For example, if we have a good faith belief that there is an imminent danger of death or serious physical injury, we may disclose information related to the emergency without delay.

Third-Party Service Providers

We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.

Marketing Communications

With your consent, or with an opportunity for you to withdraw consent, we may share your information with third parties for marketing purposes, as permitted by law.

Interactions with Other Users

If you interact with other users of the Services, those users may see your name, profile photo, and descriptions of your activity, including sending invitations to other users, chatting with other users, liking posts, following blogs.

Online Postings

When you post comments, contributions or other content to the Services, your posts may be viewed by all users and may be publicly distributed outside the Services in perpetuity.

Third-Party Advertisers

We may use third-party advertising companies to serve ads when you visit the Services. These companies may use information about your visits to the Services and other websites that are contained in web cookies in order to provide advertisements about goods and services of interest to you.

Subsidiaries, Employees, and Independent Contractors

We may disclose information about you to our subsidiaries, joint venture partners, our employees, and individuals who are our independent contractors that need to know the information in order to help us provide our Services or to process the information on our behalf. We require our subsidiaries, employees, and independent contractors to follow this Privacy Policy for personal information that we share with them.

Social Media Contacts

If you connect to the Services through a social network, your contacts on the social network will see your name, profile photo, and descriptions of your activity.

Other Third Parties

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.

We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly.

Sale or Bankruptcy

In connection with any merger, sale of company assets, or acquisition of all or a portion of our business by another company, or in the unlikely event that Shuup goes out of business or enters bankruptcy, user information would likely be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline honor commitments we made in this Privacy Policy.

With Your Consent

We may share and disclose information with your consent or at your direction. For example, we may share your information with third parties with which you authorize us to do so, such as the social media services that you connect to your site through our Publicize feature.

Aggregated and De-Identified Information

We may share information that has been aggregated or reasonably de-identified, so that the information could not reasonably be used to identify you. For instance, we may publish aggregate statistics about the use of our Services.

Published Support Requests

And if you send us a request (for example, via a support email or one of our feedback mechanisms), we reserve the right to publish that request in order to help us clarify or respond to your request or to help us support other users.

TRACKING TECHNOLOGIES

Cookies and Web Beacons

We may use cookies, web beacons, tracking pixels, and other tracking technologies in the Services to help customize the Services and improve your experience. When you access the Services, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Services. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

Internet-Based Advertising

Additionally, we may use third-party software to serve ads in the Services, implement email marketing campaigns, and manage other interactive marketing initiatives. By accessing the Services, you consent to the collection and use of your information by these third-party vendors. The Services may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with us. Once you have used these links to leave the Services, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Services.

Security of your Information

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

Policy for Children

We do not knowingly solicit information from or market to children under the age of 13. If you become aware of any data we have collected from children under age 13, please contact us by email at contact@shuup.com.

Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

OPTIONS REGARDING YOUR INFORMATION

Account Information

You may at any time review or change the information in your account or terminate your account by:

  • (1) Logging into your account settings and updating your account.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.
